Moss Golf Tours - Booking Terms and Conditions
All bookings are made and accepted in accordance with the following terms and
conditions which form the basis of your contract with Moss Golf Tours.
Deposit and booking confirmation
The person making the booking does so on behalf of all members of the group and
is responsible to Moss Golf Tours for all payments in respect of the booking. All
requests are allocated a booking reference number. We will advise if we are able to
provide the tour as requested at which point we require a deposit of 30% of the
total cost. If the booking request is made within 8 weeks of your arrival date we
will require full payment at the time of booking. Once the deposit payment is
received, we will confirm your booking and tour arrangements. From this point
a contract exists between us.
Payment of final balance
Final payment of the balance is due 8 weeks prior to the start of your tour. If the
payment is not received by the due date Moss Golf Tours reserves the right to cancel
your booking in its entirety. In such event the deposit will not be refunded. Please
note you may not receive a reminder that the final payment is due.
If you alter your booking
We will endeavour to accommodate any changes you wish to make to your tour up
to 8 weeks prior to arrival. All changes must be advised to Moss Golf Tours in
writing by the person in whose name the booking is made, quoting the booking
reference. Such changes will be subject to an administration fee of £50 each.
Non-refundable deposits and prepayments already made may be lost. Any
alterations within 8 weeks of your arrival will be treated as a cancellation
and cancellation charges, as set out below, will apply.
Cancellation charges
More than 60 days before arrival - Deposit only.
30-60 days before arrival - 75% of total cost.
30 days or less before arrival - 100% of total cost.
Changes by Moss Golf Tours
We will not cancel your booking after the date the balance is due unless it is
necessary to do so as a result of force majeure or you have failed to pay the
invoice balance. In the unlikely event we have to cancel your holiday
we will offer you another holiday of at least similar standard or a refund of
all monies paid within 14 days of your decision not to accept the alternative
offered.
We make every effort to ensure the accuracy of our descriptions of services,
accommodation and information provided. However we are not always able to
control all elements of the tour and it is possible that facilities may be
withdrawn or changed due to weather conditions, maintenance, or other
circumstances beyond our control. We will advise you of any major changes
of which we are aware.
Force majeure
Moss Golf Tours will not be liable for additional expenses incurred through
travel delay, Acts of God, force majeure or events beyond our control. Force
majeure is unusual and unforeseeable circumstances beyond our control such as
war or threat of war, riots, civil unrest, terrorist activity, industrial
disputes, natural or nuclear disaster, fire or adverse weather conditions.
Holiday prices
We guarantee that the price of your holiday will not be subject to alteration
or surcharges once a booking has been confirmed except as a result of
government action. In such a case we will absorb the first 2% of any increase
in the tour price. Should the increase exceed 10% of the total tour cost you
will be entitled to cancel the tour and receive a full refund of all money
paid. If you decide to cancel you must exercise your right to do so within 14
days of the date of the surcharge invoice.
Our responsibilities
Moss Golf Tours shall provide your travel arrangements in accordance with the
contract and accept responsibility for any loss or damage caused by our
employees. We will give all reasonable help in resolving any dispute with
independent third parties.
However, all tickets or vouchers are issued by Moss Golf Tours and all
arrangements for transport and accommodation are made by us on the condition
that we shall not be liable for injury, damage, loss, accident or delay which may
be caused by defects in the transport vehicle or by the negligence of the
vehicle driver. We shall not be responsible for, or accept liability for death,
personal injury or illness caused to you or to any member of your group.
Your responsibilities
We strongly recommend for your own protection that you take out insurance to
cover you in the event of forced cancellation, loss or damage of luggage,
personal injury, accident or illness. We also strongly recommend that if using
a hire car you take out comprehensive car insurance for the duration of your
tour.
It is your responsibility to ensure that each member of your tour group
possesses all the necessary passports, visas, health certificates as required
by law, as well as golf handicap certificates, drivers licences and any other
travel documentation. Moss Golf Tours will not be liable for loss of service or
extra expenses incurred due to a lack of such documentation.
No credit or refund will be given for any unused services included in the tour
price or for any lost, mislaid or destroyed travel documents.
Behaviour
All members of the party are expected to conduct themselves in an appropriate manner.
In the event that any member of the party causes damage to the golf course, at the
accommodation or to the transport vehicles during your tour then you or the relevant
member of your party will be liable for the cost of repairing or making good the damage.
Complaints
If you have a complaint while on tour you should immediately notify the local
supplier (hotel, golf course, car rental company or taxi company) and inform
Moss Golf Tours at the earliest opportunity. If the matter is not resolved full
details must be forwarded in writing to our office within 28 days. If you do
not act immediately and Moss Golf Tours or our suppliers are left unaware of the
problem it will not be possible for us to resolve your complaint and you
effectively forfeit any claims against us.
Jurisdiction
This contract shall be governed by and interpreted in accordance with the Law
of Scotland. Both Moss Golf Tours and you, the client, agree to submit to the
exclusive jurisdiction of the Scottish Courts.
Golf Related Information
Handicap certificate
We require all members of your group to carry current handicap certificates.
Many courses will require handicap certificates before accepting visitors on
the course. Moss Golf Tours will advise you at the time of booking if any of
the courses on the tour have a maximum handicap restriction. We accept no
responsibility if you are refused play due to an inability to comply with the
course's requirements.
Dress code
Appropriate dress should be worn at all times on the course and in the
clubhouse. Your travel details and welcome pack will advise the requirements at
each course on your tour. Moss Golf Tours accepts no responsibility if any of
the group are refused access to the course or the clubhouse due to
inappropriate attire.
Tee-Times
We will make every endeavour to confirm your requested tee-times but courses do
reserve the right to alter preferred tee-times. We will always offer you the
nearest possible alternative. Most Scottish courses will allow two ball groups
if requested, but on some occasions due to a high volume of players you may be
requested to pair up with other golfers to play as a four ball.
Playing Conditions
Although the standard of the courses we have selected is generally excellent we
are unable to always be aware of when course maintenance may be undertaken.
Moss Golf Tours can therefore not be held responsible for the condition of the
golf courses during your tour.
